These Terms and Conditions ("Terms") govern your access to and use of premadhvani.net (the "Site") and the devotional educational offerings made available through Prema Dhvani, including Mṛdaṅga Vidyā instruction, Kartāl Sādhanā instruction, and Vraja Maṇḍala Darśana guidance (collectively, the "Offerings"). Prema Dhvani is a devotional educational organization rooted in the Gauḍīya Vaiṣṇava tradition. For legal and administrative purposes, it is operated by Manfred Mong'are, also known by his initiated spiritual name Manaḥśikṣā dāsa, as an individual sole proprietor under the name "Prema Dhvani" ("Prema Dhvani," "we," "us," "our").
By accessing the Site, submitting a form, booking a conversation, enrolling in an offering, or making a payment, you ("you," "student," "participant") agree to be bound by these Terms. If you do not agree, do not use the Site or participate in the Offerings.
1. Nature of the Offerings
Prema Dhvani provides structured devotional education and guidance in mṛdaṅga, kartāl, and Vraja Maṇḍala darśana. The purpose is to help devotees approach these areas of practice through clear sequence, appropriate discipline, and respect for the Gauḍīya Vaiṣṇava paramparā.
These Offerings are not:
- A substitute for formal spiritual initiation (dīkṣā) or a relationship with an authorized guru
- Professional medical, psychological, legal, or financial advice
- A guarantee of any specific musical result, spiritual attainment, pilgrimage experience, or devotional realization
You participate voluntarily and at your own discretion.
2. Eligibility
You must be at least 18 years old to independently enroll in paid offerings or make payments through the Site. If you are under 18, a parent or legal guardian must review these Terms, consent on your behalf, and take responsibility for payment, communication, scheduling, and safety matters.
3. Enrollment, Fees, and Recurring Payments
- Current fees, tiers, and participation structures are listed on the relevant offering pages and may change at our discretion. Changes will not retroactively affect an already-active billing cycle.
- Monthly participation tiers are paid in advance through the designated payment processor. By enrolling in a recurring tier, you authorize recurring charges until you cancel.
- Certain tiers carry a stated minimum commitment period (for example, 2 or 3 months, as published on the relevant page). You are responsible for the full minimum commitment once enrolled, regardless of attendance.
- Limited-enrollment offerings, including Paramparā Sevā, are offered subject to availability and our discretion to accept or decline an applicant.
4. Payments
Payments are processed through third-party payment providers. We do not store your full payment card details. You are responsible for keeping your payment method valid and funded for any recurring participation. Failed payments may result in suspension of access until resolved.
5. Cancellations and Refunds
- You may cancel future recurring payments by contacting us through the Site's communication channels.
- Refunds are issued solely at our discretion and are evaluated case by case. No refund is guaranteed for any payment already processed, including partial months, missed sessions, or early cancellation within a minimum-commitment period.
- Rescheduling missed sessions depends on instructor availability and is not guaranteed.
6. Vraja Maṇḍala Darśana — Additional Terms
Because this offering may involve physical travel, transport, walking routes, temple visits, and site visits in India, the following additional terms apply:
- Assumption of Risk. Travel, pilgrimage, parikramā, and local transport carry inherent risks, including physical injury, illness, accident, theft, weather disruption, and circumstances involving third-party providers outside our direct control. By participating, you voluntarily assume these risks.
- Third-Party Providers. Where transport, accommodation, food, or other logistics are arranged through independent providers, Prema Dhvani acts as a guide and coordinator only and is not liable for the acts, omissions, safety practices, or service quality of those providers.
- Health and Fitness. You are responsible for assessing your own physical fitness and for disclosing relevant health conditions before participating.
- Documents and Compliance. You are solely responsible for your visa, travel documents, insurance, and compliance with Indian law during your visit.
- We strongly recommend independent travel insurance before participating in any darśana or pilgrimage-related activity.
7. Intellectual Property
Teaching materials, notation sheets, mantra documentation, session recordings, written records, site content, branding, and related materials provided through Prema Dhvani are the intellectual property of Prema Dhvani / Manfred Mong'are, except where explicitly noted as third-party or traditionally sourced material, such as traditional mantras or praṇāma verses.
You may use materials provided to you for your own personal practice only. You may not reproduce, redistribute, resell, publicly republish, or use these materials commercially without our prior written consent.
8. Communication Consent
By providing your phone number or contacting us through WhatsApp, you consent to receive offering-related communication through that channel, including scheduling, corrections, reminders, and administrative messages. You may opt out of non-essential communication at any time.
9. Conduct
You agree to engage with instructors, guides, coordinators, and other participants respectfully and in a manner consistent with the devotional context of the Offerings. We may decline participation, suspend access, or end participation for conduct that is abusive, disruptive, unsafe, or inconsistent with the spirit of the Offerings, without refund obligation beyond what is required by Section 5.
10. Disclaimers
The Site and Offerings are provided "as is" and "as available." We make no warranties, express or implied, regarding outcomes, results, uninterrupted availability, or fitness for a particular purpose. Musical progress, devotional practice, and pilgrimage experience depend on personal effort, sincerity, health, circumstances, and factors beyond our control.
11. Limitation of Liability
To the maximum extent permitted by applicable law, Prema Dhvani and Manfred Mong'are shall not be liable for any indirect, incidental, consequential, or special damages arising from your use of the Site or participation in the Offerings. Our total aggregate liability for any claim arising from the Offerings shall not exceed the amount you paid to us in the three (3) months preceding the claim.
Nothing in these Terms excludes liability that cannot be excluded under applicable law, including liability for death or personal injury caused by gross negligence where such exclusion is not permitted.
12. Indemnification
You agree to indemnify and hold harmless Prema Dhvani and Manfred Mong'are from any claims, damages, losses, or expenses, including reasonable legal fees, arising from your violation of these Terms, misuse of the Site or materials, or participation in travel, darśana, or pilgrimage-related activities.
13. Third-Party Links
The Site may reference or link to third-party services, including WhatsApp, Instagram, payment processors, scheduling tools, map services, and other platforms. We are not responsible for the content, policies, availability, or practices of these third parties.
14. Changes to the Site, Offerings, or Terms
We may modify, suspend, or discontinue any part of the Site or Offerings, and may update these Terms, at our discretion. Continued use of the Site or participation in the Offerings after changes are posted constitutes acceptance of the revised Terms. Material changes affecting active participants will be communicated where reasonably practicable.
15. Termination
We may suspend or terminate access to the Offerings at our discretion, including for breach of these Terms, non-payment, safety concerns, or conduct inconsistent with Section 9. You may end your participation or cancel future recurring payments as described in Section 5.
16. Governing Law and Disputes
These Terms are governed by and construed in accordance with the laws applicable to the operator, Manfred Mong'are, a Kenyan national. Any dispute arising from these Terms, the Site, or the Offerings shall be resolved with reference to Kenyan law and, where jurisdiction is contested, submitted to the courts of Kenya, without prejudice to any mandatory consumer protections you may hold under your own local law.
17. Force Majeure
We are not liable for any failure or delay caused by circumstances beyond our reasonable control, including illness, travel restrictions, natural disasters, political unrest, local disruptions, or platform and technology outages.
18. Entire Agreement; Severability
These Terms, together with the Privacy Policy, constitute the entire agreement between you and Prema Dhvani regarding the Site and Offerings. If any provision is found unenforceable, the remaining provisions remain in full effect.
